Terms of Service

AnalyticsTrend is a service owned by Deasil, based in British Columbia, Canada. These terms are the agreement between Deasil and you, the customer, when you create an account or use AnalyticsTrend. By creating an account you accept them.

Who may use AnalyticsTrend

You must be able to enter a binding contract, and use AnalyticsTrend for a business or for a project of your own. If you accept these terms for a company, you confirm that you may do so on its behalf.

Your account

An account holds your projects and the people who can use them, each with a Read, Write or Admin role. Keep your password to yourself; you are responsible for what is done with your login. Admins manage the account’s members, its billing and its deletion.

Acceptable use

Use AnalyticsTrend lawfully and as the documentation describes, and do not try to disrupt it or reach data that is not yours.

Adult products. AnalyticsTrend may not be used for products or services whose main purpose is sexually explicit material or sexual services: pornography, sexual webcams, escort or sexual-services listings, and similar adult entertainment.

Illegal products. AnalyticsTrend may not be used for products or services that are illegal under the laws of Canada or British Columbia, or of the place where they are offered. That includes, for example, selling illegal drugs or weapons, fraud or scams, malware, and content that infringes others' rights.

Deasil may suspend or end the service for an account that breaks these rules.

Plans, the free trial and payment

Plans, their events a month and their prices are set out in Plans and usage, monthly or yearly, plus applicable tax. Every account starts on a free trial. Once paid plans open, a trial lasts three months. If it ends without a plan, everything keeps working for 30 days; collection then stops, and the account’s events and reports are removed 60 days after the trial ended. The account and its projects stay. A subscription that ends follows the same days from the end of the period paid for.

Payments are taken by our payment provider. Refunds follow the refund policy. Past a plan’s events, collection carries on to 120% and then pauses until the next month or a larger plan.

Your data

The data your projects send is yours. Deasil processes it only to provide AnalyticsTrend to you, as the privacy policy describes, and, for customers subject to the GDPR, under the data processing agreement, which is part of these terms. You are responsible for telling the people you measure what you collect; AnalyticsTrend’s documentation sets out what that is.

Availability

AnalyticsTrend is provided as is. Deasil works to keep it running and your data safe, but does not guarantee that it will be available without interruption or free of errors.

Liability

To the extent the law allows, Deasil is not liable for indirect or consequential losses, such as lost profits or lost data, and its total liability for any claim is limited to the fees you paid for AnalyticsTrend in the 12 months before the claim.

Ending the service

You can stop at any time: cancel your plan in Billing, or delete your account. Deasil may end the service for an account that breaks these terms. When an account is deleted, its data is removed, as the privacy policy says.

Changes to these terms

Deasil may change these terms. For a material change, the account’s admins are emailed before it takes effect. Using AnalyticsTrend after that accepts the new terms.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and disputes go to the courts of British Columbia.
